1. Acceptance of Terms

By installing the Creator Club app from the Shopify App Store or using any of our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

Creator Club is a platform that enables Shopify merchants to manage creator/influencer programs. The service includes: creator applications and onboarding, learning modules, video submission management, product fulfillment via Shopify draft orders, and white-label creator portals.

3. Merchant Responsibilities

  • You must have a valid Shopify store to use Creator Club
  • You are responsible for the content of your creator program (contracts, instructions, etc.)
  • You must comply with all applicable laws including GDPR and CAN-SPAM
  • You are responsible for managing relationships with your creators
  • You must not use the service for illegal or harmful purposes

4. Creator Responsibilities

  • Provide accurate information in applications
  • Comply with the merchant's program terms and content guidelines
  • Submit original content that does not infringe on third-party rights
  • Not resell or redistribute products received through the program

5. Intellectual Property

Creators retain ownership of their submitted content. By submitting content through the platform, creators grant the merchant a license to use the content as specified in the merchant's program terms. Creator Club does not claim ownership of any user-submitted content.

6. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy. We process data on behalf of merchants and comply with Shopify's GDPR requirements for customer data requests and redaction.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify merchants of planned downtime.

8. Limitation of Liability

To the maximum extent permitted by law, Creator Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from the use of our services.

9. Termination

You may stop using our services at any time by uninstalling the app from your Shopify store. We may suspend or terminate access for violations of these terms. Upon termination, your data will be handled as described in our Privacy Policy.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify merchants of material changes via email or through the app. Continued use after changes constitutes acceptance of the updated terms.
